PRODUCTS

Jolvy sells acrylic coloring markers and related creative supplies through its online store at tryjolvy.com. Product descriptions, images, and specifications are provided as accurately as possible. However, slight variations in color may occur due to screen display differences.

We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor's display of any color will be accurate.

We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service will be corrected.

PRICING

All prices displayed on tryjolvy.com are listed in US Dollars (USD). Prices are subject to change without notice, but any changes will not affect orders that have already been confirmed.

Strikethrough or reference prices displayed on this website may reflect one or more of the following: (a) the manufacturer's suggested retail price (MSRP); (b) a price at which the item was previously offered on this website; or (c) the price at which comparable products are offered by other retailers. Not all items have been previously sold at the reference price shown. Savings claims are calculated based on the applicable reference price.

Our company strives for accuracy but reserves the right to correct any errors in pricing or descriptions and to cancel or refuse any order based on an incorrect price or description. Such corrections may be made even after an order is accepted.

PAYMENT

We accept the following payment methods: Visa, Mastercard, American Express, Discover, PayPal, Apple Pay, Google Pay, and Shop Pay. All transactions are processed securely through Shopify Payments. Your financial information is never stored on our servers.

You understand that your content (not including credit card information) may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks.

Your order is confirmed once payment has been successfully processed. You will receive an order confirmation email at the address provided during checkout.

SHIPPING AND DELIVERY

Jolvy offers FREE standard shipping on all orders to the following countries: United States, Canada, United Kingdom, and Australia.

Processing Time: Orders are typically processed within 1 to 3 business days after payment confirmation. Business days are Monday through Friday, excluding public holidays.

Estimated Delivery Times:
United States: 5 to 12 business days
Canada: 7 to 15 business days
United Kingdom: 7 to 18 business days
Australia: 10 to 20 business days

These are estimated delivery times and may vary depending on customs processing, carrier delays, or other factors beyond our control. Jolvy is not responsible for delays caused by customs, postal services, or force majeure events.

Order Tracking: Once your order has shipped, you will receive an email with a tracking number and a link to track your package. If you do not receive tracking information within 5 business days of placing your order, please contact us at contact@tryjolvy.com.

Lost or Damaged Packages: If your package is lost, damaged, or has not arrived within 30 business days of the estimated delivery date, please contact us at contact@tryjolvy.com. We will work with the carrier to resolve the issue and, if necessary, send a replacement or issue a full refund at no additional cost to you.

60-DAY HAPPINESS GUARANTEE

Your satisfaction is our priority. We offer a 60-day Happiness Guarantee on all orders placed through tryjolvy.com.

Eligibility: If for any reason you are not completely satisfied with your purchase, you may request a return or refund within 60 calendar days from the date you received your order. Products must be returned in their original condition. Used markers may still be eligible for a refund if the product did not perform as described.

How to Request a Return: To initiate a return, please contact us at contact@tryjolvy.com with your order number and reason for the return. Our customer support team will respond within 48 hours with instructions on how to proceed.

Refund Process: Once we receive and inspect the returned product, your refund will be processed to your original payment method within 5 to 10 business days. Shipping costs for returns are the responsibility of the customer unless the return is due to a defective or incorrect product, in which case Jolvy will cover return shipping.

Exchanges: We do not offer direct exchanges at this time. If you would like a different product, please return the original item for a refund and place a new order.

Non-Returnable Items: Gift cards and promotional items are non-returnable and non-refundable.

ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

To the fullest extent permitted by applicable law, Jolvy's aggregate liability for all claims relating to the services shall not exceed the greater of one hundred U.S. dollars (U.S. $100.00) or the amount you paid Jolvy for products purchased in the ninety (90) day period preceding the claim.

Because some states or jurisdictions do not allow the exclusion or the limitation of liability for consequential or incidental damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law.

PRODUCT CLAIMS DISCLAIMER

Claims such as "100% opaque", "zero bleed-through", "streak-free", "paint-like finish", and "3x more pigment" are based on product materials, manufacturing processes, and/or comparative testing with standard water-based markers. While we strive for accuracy, individual results may vary depending on paper type, technique, and usage conditions. Our product claims reflect typical performance under normal use conditions.

We are not responsible for any damage caused by improper use of our products, including but not limited to use on unsuitable surfaces, exposure to extreme conditions, or use by unsupervised children.

INDEMNIFICATION

You agree to indemnify, defend and hold harmless Jolvy, Alsama Group EURL, and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns and employees, harmless from any claim or demand, including reasonable attorneys' fees, made by any third party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of a third party.

SEVERABILITY

In the event that any provision of these Terms of Service is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms of Service, such determination shall not affect the validity and enforceability of any other remaining provisions.

Any dispute or claim relating in any way to your use of any Jolvy product or service, or to any products or services sold or distributed by Jolvy, will be resolved by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify. The Federal Arbitration Act and federal arbitration law apply to this agreement.

There is no judge or jury in arbitration, and court review of an arbitration award is limited. However, an arbitrator can award on an individual basis the same damages and relief as a court (including injunctive and declaratory relief or statutory damages), and must follow the terms of these Terms of Service as a court would.

We each agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action. If for any reason a claim proceeds in court rather than in arbitration, we each waive any right to a jury trial.

GOVERNING LAW

These Terms of Service and any separate agreements whereby we provide you Services shall be governed by and construed in accordance with the laws of France. Any dispute that cannot be resolved through arbitration shall be submitted to the competent courts of France.

ENTIRE AGREEMENT

The failure of us to exercise or enforce any right or provision of these Terms of Service shall not constitute a waiver of such right or provision.
